Selling Property in Argentina from Abroad

A buyer and a completed succession do not make a cross-border closing executable. Every seller still needs a reconciled identity, authority and document file.

Start with every person who must sign, not with the buyer or listing. For each seller, reconcile the current registry or succession position, identity, Argentine identifier, representation, foreign-residence evidence and the exact legalization or consular route. A foreign seller may be reported with a CDI, but the acting escribano and tax adviser must confirm whether CDI is sufficient or a CUIT and further tax steps are required for the specific deed.

The seller file has several independent layers

A property sale can stop even when the family agrees and a buyer is ready. The registered right, succession status, authority to sign, identity number, tax position, power of attorney and foreign documents answer different questions. One completed document does not clear the others.

The current UIF real-estate reporting instructions distinguish Argentine and foreign natural persons and provide a CDI field for a foreign person identified as buyer or seller, while expressly marking that field as non-mandatory. This establishes CDI as a recognized reporting identifier, not that every foreign seller or deed requires it or that no additional tax registration applies.

Build the closing file seller by seller

  1. Fix the right being sold: reconcile the exact property, current registry record and any succession resolution.
  2. List every required seller: include each co-owner or heir whose conformity or signature is needed.
  3. Classify identity: DNI, passport, residence, nationality and any existing CUIL, CUIT or CDI.
  4. Confirm representation: identify who signs personally and who acts under a power.
  5. Confirm foreign documents: name the exact residence, identity or civil-status document and its required intervention.
  6. Confirm tax and reporting steps: ask the escribano and tax adviser which identifier, declarations and withholding path apply.
  7. Only then fix the closing calendar: unresolved identity or legalization work remains a real dependency.

Why a deadline-bearing contract can expose hidden dependencies

A reservation, boleto or other agreement may create contractual obligations before the seller file is ready for the deed. FrontierArg cannot determine the effect of a clause or penalty. The practical research lesson is narrower: document readiness should be checked before a transaction date is treated as executable.

ARCA states that CDI processing for nonresident individuals can extend to 30 administrative business days. Consular, apostille, translation, registry and court timing are separate. No article should collapse those steps into one promised turnaround.

Questions for the escribano before setting a date

  • Who must appear as seller in the deed?
  • Which registry or succession evidence is still pending?
  • Which identifier is required for each seller and why?
  • Does any seller need a CUIT rather than only a CDI?
  • Will a representative sign, and is the power sufficient for this act?
  • Which foreign document is needed, in which language and with which intervention?
  • Which tax, withholding, banking or reporting steps are independent of the identifier?
Evidence boundaryA CDI, power, residence certificate or declaratoria proves only what that document establishes. None alone proves that every seller, tax, registry, banking and deed requirement is complete.

Can a nonresident sell property in Argentina?

Residence abroad does not by itself answer whether a sale can close. The seller must reconcile title or succession authority, identity, representation, tax and document requirements with the acting Argentine professionals.

Does every foreign seller need a CDI?

No universal rule follows from the UIF instructions. They provide a non-mandatory CDI field for a foreign natural person identified as buyer or seller. The acting escribano and tax adviser must confirm the particular transaction.

Is a power of attorney enough to complete the sale?

No. A power addresses representation. It does not replace title or succession evidence, seller identification, tax analysis, foreign-document formalities, registry checks or deed-specific requirements.

Can the seller documents be completed after signing a boleto?

That depends on the agreement and the unresolved requirements. Treat document readiness as a pre-signing question because later delays can affect a contractual calendar.

How long does a CDI take for a nonresident?

The current official ARCA page says the period can extend to 30 administrative business days for nonresident individuals. That is not a promise for a particular file or for the other closing steps.
