The bill is not in force according to the records checked on October 10, 2026. The Senate approved a modified version on August 7; it remains under consideration in Diputados. Its compensation, eviction and registry changes are proposals, rather than benefits you can already use. An upcoming agenda entry is not enactment. Before buying or renting, check the title and rules applicable to the case with local professionals.
Is Argentina’s private-property bill already law?
No: the checked record is a bill under consideration. The Senate approved a modified text on August 7, 2026. Diputados registered it as 0032-S-2026/CD-0047/2026 and referred it to Asuntos Constitucionales and Legislación General. The final Senate text has 39 articles in four chapters. We explain that version, rather than the earlier executive draft attached behind it. Senate final text, pp 1–19; Diputados parliamentary record.
The official agenda lists a joint committee meeting on October 14 at 16:00 and a request for a special session on October 21 at 12:00 with this bill among its subjects. Those entries do not establish a committee decision, a vote or enactment. Both dates are future events at this October 10 check. Official agenda.

Owners: compensation and possession are separate questions
In the checked national expropriation text, Article 10 covers objective property value and direct, immediate damage, and expressly excludes lost profit. Article 29 already links completed expropriation to final judgment, possession and payment. The Senate proposal changes the valuation and compensation rules; it does not create the first legal protection for private property. Ley 21.499, Articles 10,29.
Proposed Article 2 would admit direct, immediate lost profit supported by objective evidence. Its normal ceiling is 30% of direct actual damage (daño emergente), with an exception where the owner proves greater harm. This is neither an automatic 30% supplement nor a property-value forecast. Keep evidence of use, income and loss; a lawyer must assess any concrete claim. Final Senate text, Article 2, pp 1–3.
The bill also tightens temporary-occupation conditions. The 90-day term, with one justified extension of up to the same duration, concerns abnormal temporary occupation under proposed Article 9. It is not a general deadline for completing expropriation. Articles 7–10, pp 4–6.
Tenants and landlords: no universal 72-hour eviction
The bill would change the national CPCCN procedure from sumario to sumarísimo and expand specified early-delivery and security provisions. A court proceeding and its conditions still matter. Current Article 680 bis already allows discretionary early delivery in specified intruder cases; the proposal is not the first route to an early order. Current Articles 679,680 bis,684 bis; Bill Articles 12–22, pp 7–12.
The much-discussed 72 hours is the proposed Article 680 ter inspection before service of the claim in cases involving changed use, deterioration, harmful works or abusive or dishonest use. It is not a promise to remove every tenant within 72 hours. Proposed 680 quater requires protection-body involvement for vulnerable occupants and conditions the use of sworn security where good-faith third-party rights may be at issue. Articles 15–16, pp 8–10.
Bill Article 23 would incorporate CCyC 1222 with at least 10 calendar days’ prior notice for non-payment of dwelling rent and rules on returning or depositing keys. The consolidated current code already displays similar wording, together with a note concerning Ley 27.551 and its repeal. We do not resolve that applicability question or present every clause as new. Ask local counsel which rule applies to the actual lease and court. National CPCCN wording should not be used as a uniform provincial eviction timetable. Displayed Article 1222 and amendment/repeal note; Article 23, pp 12–13.
Buyers: title checks still come before a reform headline
The proposed registry chapter covers digital instruments and folios, a digital network for inhibitions and a federal one-stop window to be developed under further rules. Digital filing is not wholly new: the current Ley 17.801 notes CABA’s 2021 provision, and its Federal Council dates from 2008. The proposed 30-day formal-examination ceiling is not a guarantee of completed registration or a currently available nationwide portal. Current Articles 2,8–9,41 bis; Articles 24–37, pp 13–19.
For title regularisation, current Ley 24.374 Article 1 uses three years of lawful, public, peaceful and continuous possession before January 1, 2009, for eligible urban homes; family farmers living and producing on rural property are already included on the stated conditions. Bill Article 11 would replace the fixed cut-off with 10 years before the application. It does not turn any occupied property into immediately transferable, clean title. Check the recorded ownership, possession, objections and the applicable local process before paying a deposit. Current Articles 1,5–8; Article 11, pp 6–7.
Does this resolve foreign rural-land ownership?
No such conclusion follows from this bill. The final Senate text’s four chapters contain no amendment to Ley 26.737 or Ley 26.815. Those chapters appear in the earlier executive proposal attached behind the Senate communication, not in the Senate-approved version explained here. Final 39-article text; Official transmission and its attachments.
FrontierArg’s separate rural-land tracker keeps the Ley 26.737/DNU 70/2023 question at Status unresolved. What must happen before the proposed rules apply?
- Under Constitution Article 78, approval by the originating chamber sends the bill to the other chamber; approval by both sends it to the executive.
- If Diputados amends it, Article 81 governs return to the Senate and the voting-majority rules. A request for a session is not chamber approval; Article 82 requires an express decision.
- The executive may approve it or return it. Article 80 addresses a bill not returned within 10 working days; Article 83 governs veto objections and two-thirds insistence in both chambers.
- Publication and the final commencement clause must then be checked. Senate Article 38 proposes effect the day after Official Gazette publication, except the registry chapter, which would take effect 180 days after publication. There is no present effective date for these proposed changes.

Before deciding whether to buy, rent or invest
- Identify whether your question is registered ownership, actual possession, a lease, an expropriation notice or a foreign rural-land purchase.
- Keep the decision based on rules confirmed for the present case. Do not budget a faster eviction, a compensation uplift or a digital closing service from this bill alone.
- Ask the escribano for the title and registry evidence, and a local lawyer for the applicable procedure and any disputed rule.
- Compare locations and existing offers only after separating legal uncertainty from the property’s merits.

Frequently asked questions
Is the private-property bill already in force in Argentina?
No. The checked October 10, 2026 record is a Senate-approved bill under consideration in Diputados, not an enacted reform.
Does it allow every eviction within 72 hours?
No. The Senate text uses 72 hours for an inspection before service in specified harmful-use cases, not for completing every eviction.
Does it repeal the foreign rural-land law?
The final 39-article Senate text does not amend Ley 26.737. FrontierArg keeps the separate Ley 26.737/DNU 70/2023 status unresolved.
Is there an automatic 30% extra compensation payment?
No. Proposed Article 2 concerns proved direct lost profit and a normal 30% ceiling relative to direct actual damage (daño emergente), with a greater-proved-harm exception. It is not an automatic supplement.
When would the proposed registry rules apply?
Senate Article 38 proposes 180 days after Official Gazette publication for chapter III. Final enactment, publication and wording must first be checked.
